Fatal Auto Accidents in California

San Diego, CA – Pedestrian Killed in Mira Mesa Blvd Crash at W View PwkyEach year, motor vehicle accidents lead to hundreds of thousands of injuries throughout California. For those encountering their first car accident, navigating the process of seeking compensation from the responsible party can be challenging. Many accidents result from poor decisions made by drivers. This means that the injured party has to establish negligence on the part of the other driver to prevail. This involves fulfilling four fundamental elements of fault:

  • Duty: The injured individual must establish that the other driver owed them a duty of care. As drivers, we are obliged to operate our vehicles with mindfulness and consideration for others on the road.
  • Breach: Drivers are expected to consistently fulfill their duty of care by acting reasonably. Reasonableness is evaluated based on what an average driver would do, given the circumstances of the accident. If an average driver, aware of the risks involved, would have acted differently but the negligent driver did not, they are deemed to have breached their duty through negligence.
  • Causation: The injured party must demonstrate that their injuries or property damage directly resulted from the negligent actions of the other driver.
  • Damages: Car accident victims must substantiate that the negligent driver’s actions resulted in financial losses warranting compensation. Common damages include medical expenses, lost income, pain and suffering, and other associated losses.
