Car Accidents in California

Sun Valley, CA - Crash with Injuries at Sheldon St & Laurel Canyon BlvdEvery year, California witnesses hundreds of thousands of injuries stemming from motor vehicle accidents. For those experiencing their initial car crash, pursuing compensation from the at-fault party can feel overwhelming. A significant number of these accidents arise from driver errors, compelling the injured parties to establish negligence on the part of the other driver. This involves establishing four crucial elements of fault:

  1. Duty: The injured party must show that the other driver had to exercise care while operating a vehicle, as all drivers are expected to drive responsibly and considerately towards others on the road.
  2. Breach: Drivers are required to consistently uphold this duty by acting reasonably. Reasonableness is determined by how an average driver would behave in similar circumstances. If the negligent driver’s actions deviate from what an average driver would do, given the same risks, they are considered to have breached their duty through negligence.
  3. Causation: The injured party needs to establish a direct link between their injuries or property damage and the negligent actions of the other driver.
  4. Damages: Victims must demonstrate that the negligent driver’s actions resulted in financial losses that justify compensation. Common damages include medical bills, lost wages, pain and suffering, and other related losses.
